Twiny | Your AI Digital Twin

1. Acceptance of Terms

By accessing or using Twiny ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users, including creators (those who build digital twins) and fans (those who interact with digital twins).

2. Description of Service

Twiny is a SaaS platform that allows creators and businesses to build AI-powered digital twins trained on their own knowledge base. These twins can interact with fans and customers via WhatsApp and other supported channels, with optional paywall and monetisation features.

3. Account Registration

You must create an account to use the Platform. You are responsible for maintaining the security of your account credentials. You must provide accurate and up-to-date information. You may not share your account with others or create multiple accounts for the same person. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree not to use Twiny to:

Impersonate real people without their explicit consent.
Generate or distribute harmful, illegal, abusive, defamatory, or fraudulent content.
Send unsolicited messages (spam) to WhatsApp users.
Violate Meta's WhatsApp Business Policy or any applicable laws.
Attempt to reverse engineer, scrape, or disrupt the Platform.
Use the Platform for any purpose that could harm minors.

We reserve the right to remove content and suspend accounts that violate these rules without prior notice.

5. Your Content

You retain ownership of all content you upload to train your digital twin. By uploading content, you grant Twiny a non-exclusive, worldwide licence to process and store that content solely for the purpose of operating your twin. You are solely responsible for ensuring you have the rights to any content you upload and that it does not infringe third-party intellectual property rights.

6. AI-Generated Responses

Responses generated by digital twins are produced by AI and may not always be accurate, complete, or appropriate. Twiny does not guarantee the accuracy of AI-generated content. Creators are responsible for the content their twin produces and should review their knowledge base and persona settings to ensure appropriate responses.

7. Payments and Subscriptions

Certain features of Twiny require a paid subscription. Payments are processed securely via Stripe. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis — DM @loumidea (https://x.com/loumidea) within 7 days of a charge for refund requests. Twiny takes a platform fee on fan subscriptions as detailed in your plan.

8. Intellectual Property

All Platform software, design, branding, and technology are owned by Twiny and protected by intellectual property laws. You may not copy, reproduce, or distribute any part of the Platform without written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Twiny shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of revenue, data, or business opportunities. Our total liability shall not exceed the amount you paid to us in the 3 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. You may delete your account from the dashboard settings. We may suspend or terminate your account for violation of these terms. Upon termination, your access to the Platform will cease and your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes via email at least 14 days before changes take effect. Continued use of the Platform after that date constitutes acceptance.

12. Governing Law

These terms are governed by the laws of Italy, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
