Terms of Service

1. Acceptance

By creating an account or using Twiny ("the Platform") you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Platform. These terms apply to creators and businesses who build twins, and to fans and customers who interact with them.

2. The service

Twiny lets creators and businesses build an AI digital twin trained on their own voice, style and knowledge. With it you can create images, videos, music and voice in Media Studio and Audio, run automated content Agents that plan and produce posts, publish to connected social accounts, and let your twin chat with your fans and customers on WhatsApp, Telegram and Instagram, with optional paid fan subscriptions. Features depend on your plan and may change over time.

3. Account and minimum age

You must be at least 18 years old to open an account, and act on your own behalf or for a business you are authorised to represent. People who chat with a twin or subscribe to a creator must be at least 16. Keep your login details secure, give accurate information, and do not share your account or create several accounts for the same person. You are responsible for what happens in your account.

4. Acceptable use

You agree not to use Twiny to:

• Upload or generate images, video or voices of real people without their consent, impersonate anyone, or create sexual, misleading or harmful content about anyone, especially minors.
• Generate or distribute illegal, abusive, defamatory, hateful or fraudulent content.
• Send unsolicited messages (spam) or contact people who have not chosen to talk to your twin.
• Break Meta's WhatsApp Business Policy, the rules of any connected platform, or any applicable law.
• Reverse engineer, scrape, overload or disrupt the Platform.
• Hide from your audience that they are talking to an AI.

We may remove content and suspend accounts that break these rules. Where the law requires it, or unless there is an urgent risk, we will tell you why.

5. Faces, voices and impersonation

By uploading a face photo or voice sample you confirm that it is your own, or that the person shown or heard has given you their explicit written consent to create and use their likeness or voice with Twiny. Keep that consent and show it to us if we ask. If you believe your face, voice or identity is being used on Twiny without permission, write to privacy@twiny.dev with a link or description. We will review the report promptly, remove the material and any cloned voice when the report is well-founded, and may suspend the account responsible.

6. Your content

You keep ownership of the content you upload. You give Twiny a non-exclusive, worldwide, royalty-free licence to host, process and transmit that content, including sending it to the AI providers listed in our Privacy Policy, only to run the service for you. The licence ends when you delete the content or your account, except for copies we must keep by law. You are responsible for having the rights to everything you upload.

7. AI-generated content

Twiny uses third-party AI models. Their output can be inaccurate, unexpected or similar to existing material, so review it before you publish. As between you and Twiny, you own the outputs you generate, to the extent the law allows, and you may use them commercially. We cannot guarantee that an output is protected by copyright or that it is unique: other users may get similar results. Some models come with their own terms that also apply to their outputs; for example music made with Suno through Kie.ai follows Suno's terms for commercial use. You are responsible for what you publish with Twiny and for the replies your twin gives. If content shows realistic people, places or events, or uses a cloned voice, label it as AI-generated where you publish it, in line with the EU AI Act and each platform's rules.

8. Credits

• Credits are units you spend on generations (images, video, music, voice and agent runs).
• Credits have no cash value, cannot be exchanged for money and cannot be transferred to another account.
• Credits included in a plan are tied to that plan and its billing period, as described on the Pricing page.
• Credits you buy in packs do not expire while your account is active.
• All credits are lost when your account is closed.
• If a generation fails, the credits reserved for it are returned to your balance automatically.

9. Plans, payments and renewal

Payments are processed by Stripe. Prices are shown on the Pricing page and at checkout before you pay. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from Billing in your dashboard; the cancellation takes effect at the end of the current period and you keep access until then. If you sell subscriptions to your fans through Twiny, we keep a platform fee of 10% of each fan payment; Stripe's processing fees also apply.

10. Right of withdrawal and refunds

If you are a consumer in the EU, you normally have 14 days to withdraw from a purchase without giving a reason. During those 14 days you can do it with the "Withdraw from contract here" button in Billing. For digital content and services the rules work like this:

• At checkout you can ask us to start immediately and acknowledge that you lose the right of withdrawal once the service is supplied. Credits you have used to generate content count as supplied, so you cannot get them back.
• Credit packs: if you have not used any credits from a pack, you can ask for a full refund within 14 days of purchase by writing to privacy@twiny.dev.
• Subscriptions: if you withdraw within 14 days of your first payment, we refund it minus the value of what you have already used in that period, such as credits spent.
• Refunds go back to your original payment method within 14 days of your request. Refunded credits are removed from your balance.

This does not limit your legal guarantee if the service is faulty or not as described. For any other refund request, write to privacy@twiny.dev.

11. Our intellectual property

The Platform's software, design, branding and technology belong to Twiny or its licensors. You may not copy, reproduce or distribute any part of the Platform without written permission.

12. Your responsibility for content

You will compensate Twiny for losses, damages and reasonable legal costs arising from third-party claims about content you upload or publish with Twiny, or about your breach of these terms, to the extent they are caused by you. If you are a consumer, this applies only as far as the law allows.

13. Limitation of liability

To the maximum extent permitted by law, Twiny is not liable for indirect or consequential damages, such as loss of revenue, data or business opportunities, and our total liability is limited to the amount you paid us in the 3 months before the claim. These limits do not apply to liability for wilful misconduct or gross negligence, for death or personal injury, or where the law does not allow them, and they do not reduce the rights that consumer protection law gives you.

14. Termination

You can close your account at any time from Settings. We may suspend or close accounts that seriously or repeatedly break these terms. When an account is closed, access ends, remaining credits are lost and data is deleted as described in our Privacy Policy.

15. Changes to these terms

We may update these terms. We will email registered users about material changes at least 14 days before they take effect. If you do not agree, you can close your account before that date; continuing to use the Platform afterwards means you accept the new terms.

16. Governing law and disputes

These terms are governed by Italian law. If you use Twiny for your business, the courts of Italy have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts of that country or of Italy.
